Reasons for Exemption
The Board’s action to revoke Automatic Board Order Permit No. 10248 is exempt from CEQA under the Class 21, Enforcement Actions by Regulatory Agencies categorical exemption (CEQA Guidelines § 15321). The Board’s action results from staff’s determination that the Automatic Board Order permit was issued in error and may be revoked pursuant to Title 23, Section 28(a)(2). The encroachment permitted under Automatic Board Order Permit No. 10248 was found to be a system feature that falls within the responsibility of the local maintaining agency and for which no permit should have been issued.
