Reasons for Exemption
Staff has determined that the Project is exempt from CEQA pursuant to State CEQA Guidelines Section 15301 (Existing Facilities). Section 15301 applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The Project involves façade improvements to an existing restaurant that will improve and update the façade. The drive-through lane will feature an upgraded menu board to remain in the same location with the addition of a menu board canopy; no changes are proposed to the current drive-through configuration. No expansions of use or physical site improvements are proposed with the Project.
