Document Description
The proposed project involves a License Agreement from the U.S. Coast Guard (USCG) for the use of approximately 665 square-foot (sq. ft.) office space, with joint use of a 400 sq. ft. common space, and joint use of a rooftop space at the Joint-Harbor Operations Center (JHOC) facility in the City of San Diego for the District's Harbor Police Department (HPD), Maritime Operations team, and USCG to conduct joint homeland security and public safety functions. Since January 2006, HPD, Maritime Operations, and USCG have conducted joint homeland security and public safety operations at the JHOC facility. The License Agreement will allow for continued joint homeland security and public safety functions. No new development, construction, or increase in the size of the property is proposed or authorized as part of the proposed project.
The License Agreement is anticipated to commence on April 1, 2021, and end on March 31, 2026, for a total term of five (5) years with three (3) five year options. The License Agreement provides that the District will indemnify and hold harmless the USCG from liability and results from any act, default or omission of the District in connection with HPD and Maritime Operations use of the JHOC facility.

Reasons for Exemption
The proposed project is determined to be Categorically Exempt pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15301 (Existing Facilities) and Section 3.a. of the District’s Guidelines for Compliance with CEQA because it consists of a License agreement for joint homeland security, public safety, dispatch, marina, and surveillance operations, would involve no expansion of use beyond that previously existing, and would not result in a significant cumulative impact due to the continuation of the existing use. The District has determined none of the six exceptions to the use of a categorical exemption apply to this project (CEQA Guidelines Section 15300.2). Section 3.a. of the District’s CEQA Guidelines is as follows:
3.a. Existing Facilities (SG § 15301) (Class 1): Includes operation, repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing.
