Reasons for Exemption
The Planning Commission evaluated the project's potential environmental impacts and determined that the proposed project qualifies for a Class 3 Exemption from the California Environmental Quality Act (CEQA). Class 3 consists of construction and location of limited numbers of new small structures or facilities. In urbanized areas, this exemption applies to commercial buildings not exceeding 10,000 square feet. The proposed project is a request to add a new hydrogen fuel dispenser adjacent to the existing southerly fueling canopy, as well as associated equipment located to the rear
(east) of the existing building. These improvements meet the criteria for new small structure or facilities; and, therefore, this exemption is applicable. Pursuant to Section 15300.2 (c) and 15303 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project is categorically exempt from the provisions of CEQA.
