The project is exempt from CEQA under the Class 1, Existing Facilities categorical exemption (CEQA Guidelines § 15301), because the activity consists of the authorization of an existing retaining wall and wrought iron fence with negligible or no expansion of use, and under Class 2, Replacement or Reconstruction categorical exemption (CEQA Guidelines § 15302), because the activity consists of replacement of existing bank protection and removal of an existing stairway and handrail located on the same site with substantially the same purpose and capacity. Further, none of the exceptions to the exemption in CEQA Guidelines § 15300.2 apply. Please note, the signed NOE is not attached.
