Document Description
The proposed action involves a three-year agreement between Port of Long Beach and Port of Los Angeles (Ports) with PortCheck, LLC (PortCheck) and Marine Terminal Operators (MTOs) for Portcheck to provide Clean Truck Fund (CTF) Rate collection services for the Ports. The proposed Agreement requires PortCheck to provide the following: 1) Develop an information system and model that would implement the collection of CTF Rates and application of exemptions (Rate Collection System); 2) Perform operational CTF Rate collection services; and 3) The Ports agree to compensate PortCheck under the proposed Agreement by payment of (1) Rate Collection System development costs and (2) operating costs for CTF Rate collection services. The proposed term of the agreement between PortCheck, the Ports, and MTOs is expected through 2024 and is subject to Federal Maritime Commission review pursuant to the Shipping Act of 1984.

CEQA Guidelines §15061(b)(3) Common Sense Exemption: It can be seen with certainty that there is no possibility that the approval of the Clean Truck Rate Collection Services Agreement may have a significant effect on the environment since it is administrative and procedural in nature and will support the San Pedro Bay Ports Clean Air Action Plan which identifies strategies to reduce air emissions from port-related sources, including heavy-duty drayage trucks. CEQA Guidelines §15306 Information Collection: the Clean Truck Rate Collection Services Agreement involves basic data collection, research, experimental management, and resource evaluation activities which do not result in a serious or major disturbance to an environmental resource since the Agreement consists of the development of an information system and model by PortCheck to facilitate the collection of CTF Rate fees involving the identification and collection of information relevant to trucks servicing terminals at the ports by accessing the Ports’ Drayage Truck Registry system to apply exempt or non-exempt status to trucks; and collection of truck, cargo, and Licensed Motor Carrier information from MTOs.
