The project is limited to use of a backhoe to skim the accumulated mine tailings/gravel on gravel bars associated with the bank of Spanish Creek. The skimmed gravel will be placed in a dump truck and transported to an onsite stockpile location. The stockpile location is located in an area of the property that will prevent any associated runoff, from the excavated gravel stockpile, from returning to the creek or other waters of the state. The gravel will be used strictly for personal use to initiate filling and leveling of the property for the purpose constructing of a new private residence. Not more than 100 cubic yards of gravel will be removed from Spanish Creek per year for a period not to exceed five (5) years. Following the first year, the quantity of gravel permitted for removal from the bar shall be established by CDFW through annual review of the replenishment of gravel to the site.
