Document Description
The project is limited to two encroachments on the South Fork Eel River. One encroachment is to remove graded fill and a log retaining wall within the riparian setback along the South Fork Eel River. Work will include excavation, removal of fill and logs, proper spoiling of removed materials, grading and installation of erosion control measures. The other encroachment is for water diversion from a spring for domestic use. Work for the water diversion will include use and maintenance of the water diversion infrastructure.

Reasons for Exemption
The project will permit existing water diversion and minor alteration of land for improperly spoiled sediment and grading associated with past cannabis cultivation activities. Work was conducted without a Streambed Alteration Agreement (Fish & Game Code [FGC] Section 1602) before September 18, 2019. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
