Document Description
Rainbow Municipal District Project involves installation of a new 2000-linear-foot, 8-inch water pipeline wholly within the District’s existing right-of-way easement along Rainbow Heights Road. The project site begins at the intersection of Rainbow Heights Road and Anderson Road and continues south to tie into the existing transmission main south of 7450 Rainbow Heights Road, Fallbrook, California 92028. The project includes installation of fire hydrants and replacement of remote water meters. A Notice of Exemption was completed. State CEQA Guidelines §15304 (Minor Alterations to Land). This class 4 exemption allow for minor public or private alterations in the condition of land, water, and/or vegetation which do not involve the removal of healthy, mature, scenic trees except for forestry or agricultural purposes. Examples include minor trenching and backfilling where the surface is restored (Guidelines §15304(f)). The trenching required for the placement of the proposed pipeline and associated fire hydrants would be located entirely within the existing, paved road within the water district right-of-way easement. A biological assessment of the project area was conducted, and it was determined that biological resources would be avoided and therefore, there would be no impacts to biological resources, including trees, as a result of the project. State CEQA Guidelines §15061(b)(3) (Common Sense Exemption). This activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environmental. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The project involves trenching for and the placement of approximately 2000 liner feet of a new, 8-inch water pipeline wholly within an existing, paved road within the water district right-of-way easement. If the project would not have included the aboveground fire hydrants, the project would have been statutorily exempt from CEQA under Guidelines §15282(k). There is no possibility that the project will have a significant effect on the environment.
