Class 1 (15302(b)) – Replacement or Reconstruction.
The project proposes to replace the existing public access pier/dock system at Highlands Park and construct a new public access pier with docks, motorized and non-motorized boat slips and viewing platforms. The pier, dock and associated structures will replace the existing structures. This project includes the installation of 32 pilings along the pier. This project is associated with the Master Plan to Revitalize Highlands Park in Clearlake, CA. Although a larger planning effort has been completed by the City of Clearlake, the County of Lake has jurisdiction over permitting of lakebed structures.
Biological and wetland surveys were completed (Nov. 2017) as part of the Master Planning process. No wetlands occur in the survey area above the High Water Mark of Clear Lake where the docks and pilings will be installed. Additionally, no aquatic vegetation was present along the shoreline where the pier will be installed.
This project meets the criteria for the categorical exemption because the structure will replace an existing structure, no littoral vegetation will be removed and all work in the lake will occur between October 15 and December 31. The project will not result in significant adverse environmental effects to wetlands or riparian habitats. The Lake County Community Development Department has determined that the project will not have a significant effect on the environment and is, therefore, exempt from the provisions of CEQA.
