Reasons for Exemption
The State CEQA Guidelines provide a series of Statutory Exemptions for actions that have been deemed by the State Legislature to be exempt from the California Environmental Quality Act (CEQA). The proposed installation of the new 8-inch water pipeline has been determined to qualify for a Statutory Exemption under Paragraph 21080.21 CEQA the statute and the State CEQA Guidelines, Section 15282(k). Installation of this new pipeline over a distance of approximately 1,100 feet will ensure that the District’s potable water supply in the City of Big Bear Lake can be operated safely and efficiently. Statutory Exemption 21080.21 exempts “(a) This division does not apply to any project of less than one mile in length within a public street or highway or any other public right-f-way for the installation of a replacement pipeline or the maintenance, repair, restoration, reconditioning, relocation, replacement, removal, or demolition of an existing pipeline. The proposed installation and future operation of this segment of the water infrastructure system have been determined to not fall under the jurisdiction of CEQA and the State CEQA Guidelines because it is in an engineered public roadway and is less than one mile in length. Therefore, this action qualifies with the requirements for a Statutory Exemption, under Paragraph 21080.21 of the CEQA statute.
