The encroachment permits implement the MOU between EBRPD and PG&E for PG&E’s Community Pipeline Safety Initiative. The MOU was approved on March 21, 2017 and executed March 22, 2017, and found to be exempt from the California Environmental Quality Act (CEQA). As detailed in the MOU, one encroachment permit is for tree-removal work conducted within Briones Regional Park, and the second is for tree-removal work conducted along the Lafayette/Moraga Regional Trail.

EBRPD has reviewed the encroachment permits and determined that their issuance by EBRPD staff implements the already approved MOU and is exempt from CEQA pursuant to the following exemptions: a. 14 CCR Section 15268 – Ministerial Projects. Ministerial projects are exempt from the requirements of CEQA. b. Public Resources Code Section 21080(b)(1) – CEQA does not apply to ministerial projects proposed to be carried out or approved by public agencies.
