Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2020-0209-R 1, pursuant to Section 1602 of the Fish and Game Code to Todd Phelps.
The project is limited to two encroachments. One encroachment is for water diversion from an unnamed tributary to Mattole Canyon Creek. Work for the water diversion will include use and maintenance of the water diversion infrastructure. The second proposed encroachment is to realign a stream to its native channel by realigning the culvert crossing. Work for this encroachment will include excavation, removal of the existing culvert, placement of a 30" minimum diameter culvert in alignment with the stream channel, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion.

The project to be completed is located with in the Mattole Canyon Creek watershed, approximately 6.9 miles southwest of the town of Myers Flat, County of Humboldt, State of California. The project is located in Section 21 , T3S, R2E, Humboldt Base and Meridian; in the Ettersburg U.S. Geological Survey 7.5-minute quadrangle; Assessor's Parcel Number 221 -121-010; latitude 40.1859 N and longitude 123.9650 Wat the point of diversion (POD).

Reasons for Exemption
The project includes permitting an existing diversion of water and improving a stream crossing. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
