This Amendment (SWPAO #12023-A) amends the “Multi-Year Agreement Among the Department of Water Resources of the State of California, Coachella Valley Water District and Kern County Water Agency for a Change in Point of Delivery for State Water Project Water and Conveyance of Non-Project Water (SWPAO #12023).”
The original Agreement (SWPAO #12023), dated July 30, 2013, sets forth the terms and provisions for the conveyance of up to 16,500 acre-feet per year of Non-Project Water to Coachella Valley Water District through December 31, 2035. This Non-Project Water was originally purchased by Glorious Land Company (GLC) from Rosedale-Rio Bravo Water Storage District (RRBWSD), a member unit of Kern County Water Agency (KCWA), in 2005 for a new residential and multi-use development project located in Shavers Valley in Riverside County (GLC/RRBWSD Agreement). However, due to construction delays and GLC’s inability to receive this water, CVWD and GLC entered into an assignment agreement in July 2012 under which GLC assigned its rights and obligations for the water acquired under GLC/RRBWSD Agreement to CVWD (Assigned Water). CVWD is to provide a water supply to GLC’s Shavers Valley project once it is constructed.
