- Reasons for Exemption
- The State CEQA Guidelines provide a series of categorical exemptions for projects that have been deemed to have minimal impacts on the environment. The proposed repair, rehabilitation and maintenance of the City Creek Bypass channel have no potential to cause significant adverse effects on the environment and will ensure the channel can continue to convey flood flows in a manner consistent with historic operation. Categorical Exemption Class I exempts “operation, repair... or minor alteration of existing public or private structures, facilities and mechanical equipment...involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination.” The potential for significant effect from implementing this repair project has been evaluated for the proposed project. The proposed City Creek Bypass channel repairs, rehabilitation, and maintenance have been determined not to have a potential to cause significant adverse environmental effects as a result of implementation. Therefore, this proposed action is not forecast to cause any potential for significant adverse environmental impacts and qualifies with the requirements for Class 1 exemption.
