- Issue a right-of-entry (ROE) permit to Union Pacific Railroad (UPRR) into McLaughlin Eastshore State Park (MESP) to allow UPRR to access approximately 0.14 acres of soil cap over the Liquid Gold superfund site that extends into MESP and facilitate fence realignment to fulfill a Environmental Protection Agency recommendation that the soil cap be fully enclosed by fencing. UPRR will hire a contractor to install approximately 11 0' of fence that will replace approximately 100' of existing fence. Minimal vegetation will be cleared along fence line. The installed fence will be 6-foot high chain link with razor wire and tie in with existing perimeter fence. UPRR will coordinate all access and construction with East Bay Regional Park District (EBRPD). EBRPD will oversee activities per the terms of the State Parks ROE. All work conducted in association with the ROE permit will comply with all State and Federal environmental laws, including but not limited to the Endangered Species Act, California Environmental Quality Act (CEQA), and Section 5024 of the Public Resources Code.
