Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
§15304 and §15333
Reasons for Exemption
Board staff has determined the proposed project is exempt from CEQA under the Class 4, Minor Alterations to Land, and Class 33, Small Habitat Restoration Projects categorical exemptions (CEQA Guidelines §15304 and §15333) because the project involves minor alterations to land to reduce and/or eliminate erosion and sedimentation, and restore/stabilize two sections of the Dry Creek embankment. In addition, the proposed project encompasses an approximately 1.3-acre site, thereby qualifying under a CEQA Guidelines’ Class 33 categorical exemption, where a restoration project site must be less than five acres in size. Further, none of the exceptions to the exemption in CEQA Guidelines §15300.2 apply. Please note, the NOE is not attached.
