- The District holds a long-term water service contract with the U.S. Bureau of Reclamation ("Existing Contract") for the delivery of Central Valley Project ("CVP") water. The Existing Contract which will be converted into a repayment contract pursuant to the 2016 Water Infrastructure Improvements for the Nation (WlIN) Act. Early repayment will entitle the District to a discount on the capital amounts currently owed to the United States under the Existing Contract. The conversion allows the District to continue receiving water deliveries in the same amount, and under the same substantive terms, as its Existing Contract; and the Existing Contract as amended will continue on so long as the District pays applicable rates and charges under the agreement.

- The proposed action is the conversion of a long-term water service contract to a repayment contract under Federal law. Ongoing water deliveries to this contractor are normal, intrinsic part of a CVP operation that pre-dates CEQA. (Guidelines § 15261(a).) No changes in the operations of the Project or the delivery of water will result from the proposed action, and existing facilities and services will not be expanded or modified as a result of this action. (Guidelines § 15301). Furthermore, organizational and financial activities do not constitute a project subject to CEQA review absent evidence the activities will trigger a change in the existing physical environment. There is no such evidence in this instance.
