Document Description
The Hazardous Materials Building and Transportation Shop at the SMUD 59th Street yard were vacated in 2013. Prior to this, the buildings were primarily used for preparation of transformers and other equipment for scrap or disposal and fleet maintenance, respectively. SMUD is proposing to remove equipment and clean up hazardous waste that may be present at these locations. To accomplish this, the HVAC ductwork in the Hazardous Materials Building which was found to contain hazardous materials will be removed. Within the Transportation Shop, SMUD will first remove hydraulic oil from the vehicle lift pits and wash the pits. Then the concrete slab will be cut to expose and remove the hydraulic lift equipment and piping. These areas will be backfilled with gravel and capped with sand/slurry cement. Lastly, two underground oil/water separator sumps, one located at the Transportation Shop and the other on the parcel south of the light rail tracks will be removed. Soil will be tested prior to backfilling the excavation of the oil/water separator sumps with crushed rock and capping them with cement. During the activities described above, SMUD will drill and test soils at the vehicle lifts and both oil/water separators to ensure the surrounding soil is clean. If contaminated soil is found, SMUD will perform additional remedial actions to clean up the contaminated soil. SMUD is proposing to start the demo and cleanup work in August 2020 or soon thereafter. The proposed activities are expected to take up to four months.

Reasons for Exemption
SMUD has reviewed and determined that the Project is categorically exempt from the provisions of CEQA pursuant to Sections 15301 (a)(b)(d) (Existing Facilities), 15304(f) (Minor Alterations to Land), and 15061 (b)(3) (Common Sense Exemption). Section 15301 (a)(b) which reads "Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination", "(a) Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances", "(b) existing facilities of both investor and publicly-owned utilities used to provide electric power, natural gas, sewerage, or other public utility services", (d) Restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety, unless it is determined that the damage was substantial and resulted from an environmental hazard such as earthquake, landslide, or flood" ... , Section 15304(f) states that "Class 4 consists of minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry or agricultural purposes" such as minor trenching and backfilling where the surface is restored. Lastly, the common sense exemption which states that "CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA." The Project will involve the removal of equipment and minor alternation of an existing facilities resulting in no change or expansion of use, and minor alterations in the condition of land. Therefore, no further environmental review is required.
