Document Description
The Conservancy is entering into one short-term license agreement authorizing the Tahoe Keys Property Owners Association (TKPOA) to use an unpaved shared road to access TKPOA’s East Channel East Bulkhead replacement project. TKPOA will use the shared road to access the replacement project site on its bulkhead. Use of the road will include the transportation of the following across the shared access road: construction materials, excavated soil, and importation of base materials. Pursuant to the license agreement for the specified shared road, TKPOA will not modify the road and all construction work for replacement of the bulkhead will be done on TKPOA property.

Reasons for Exemption
The granting of this license agreement is exempt under Class 2 because the use of the shared road for TKPOA’s replacement of its bulkhead is consistent with the permit granted to TKPOA from Lahontan Regional Water Quality Control Board on July 31, 2020. Under the terms of that permit, this project as permitted will consist of the replacement of a failing bulkhead in the east channel of Tahoe Keys and will not have a significant effect on the environment, and therefore, is exempt from CEQA pursuant to Section 15302, Replacement or Reconstruction.
