Document Description
The Federal Clean Air Act section f 82 (a)(3)(A) requires all ozone non-attainment areas to have in place a program that requires emissions statements from stationary sources of NOx and VOC. Due to BAAQMD's marginal non-attainment status with the 2015 8-hour ozone standards, the Air District is required to submit a certification that its existing program continues to comply with federal requirements. BAAQMD intends to certify that Rule 2-L-429 is adequate and continues to fulfill the Clean Air Act section L82(a)(3)(B) emissions statement requirements. This project also seeks to adopt Emissions Statement certifications for the 1997 and 2008 8-hour Ozone NAAQS.

This project is categorically exempt from provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) pursuant to State CEQA Guidelines, Sections 15061, subd. (b)(3) (the 'common sense' exemption). The finds made in the proposed Emissions Statement certification do not affect air emissions from any sources, and can be seen with certainty to have no possibility of causing significant environmental effects. The District intends to file a Notice of Exemption pursuant to State CEQA Guidelines, Section 15062.
