Document Description
Grant a Right of Entry (ROE) to Liberty Utilities for access to Ed Z’berg Sugar Pine Point State Park to remove and replace a total of thirty-two (32) power poles as well as access to, and use of, two (2) staging areas to aid in the removal and replacement of power poles. The staging areas are describe as Staging Area 1: south east portion of the paved Sugar Pine Day Use parking lot on the campground side of SR 89, accessed via SR 89 and Campground Entrance Road;
Staging Area 2: boneyard/burn pile dirt area accessed via SR 89 and State Park South Fire Road. Work will:
• Remove nine (9) trees greater than 14” DBH: four (4) Jeffrey pine, three (3) white fir, and two (2) Lodgepole and prune additional trees as needed;
• Remove thirty-two (32) old power poles;
• Use a backhoe to excavate thirty-two (32) 8’ deep by 24” in diameter holes;
• Implement a Dewatering Plan if water is encountered during excavation;
• Use a utility truck to set thirty-two (32) new power poles and backfill all holes with weed free soil or gravel and top with existing soil, or backfill entirely with existing soil;
• Provide traffic control onsite during the project, including but not limited to construction flaggers to ensure safe entry into Sugar Pine Point SP, continuous traffic flow along SR 89, and safe crossing of pedestrians and bikers across SR 89.

Reasons for Exemption
Project consists of the repair, maintenance or minor alteration of existing private or public structures, facilities, involving negligible or no expansion of use beyond current levels; replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced; minor public or private alterations in the condition of land, water and/or vegetation which does not involve removal of healthy, mature, scenic trees except for forestry or agricultural purposes; and the minor alteration in land use limitations in areas with an average slope of less than 20%, which does not result in any changes in land use or density, and are included as “Utility repairs or minor upgrades” and “issuance of permits” in the Department of Parks and Recreation’s list of exempt activities in accordance with CCR § 15300.4.
