Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Section 15301
Reasons for Exemption
Section 15301 of the CEQA Guidelines exempts from CEQA review the "operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination." This includes publicly owned existing facilities used to provide sewage. The key consideration in determining whether this exemption applies is whether the project involves "negligible or no expansion of use beyond that existing at the time of the lead agency's determination". The proposed project consists of the award of a construction contract to allow for replacement and maintenance of a deteriorating sewer pipeline. Therefore, the project is categorically exempt in accordance with Section 15301 of the CEQA Guidelines because it involves the maintenance of existing public facilities involving no or negligible expansion of existing use.
