Reasons for Exemption
Staff has evaluated the improvement of the one mile pedestrian walking trail at the 80 acre open space area (APN 519-0-210-055) on Tierra Rejada Road for compliance with the California Environmental Quality Act. The action is exempt from CEQA as a Class 4 (minor alterations to land) exemption from CEQA based on State CEQA Guidelines Section 15301. This applies on the basis that there are no mature trees that will be removed as a part of this project and all grading will occur on land with a slope of less than 10%. In addition, the trail improvement is exempt from CEQA under the "catch-all exception" because it can be seen with certainty that the trail improvement will not have the possibility to have a significant effect on the environment. This exception applies because the MWPRCA is not proposing 519-0-to change the property to a new use at this time.
