Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2019-0908-R1, pursuant to Section 1602 of the Fish and Game Code to Julian Rivera. The project is limited to two encroachments. One encroachment is for water diversion for domestic use from an unnamed tributary to the Klamath River. Work for the water diversion will include modification, use, and maintenance of the water diversion infrastructure. The second proposed encroachment will permit removal of a water diversion structure and associated material from an unnamed tributary to the Klamath River. This point of diversion (POD) is not in compliance with CDFW and is located on federal forest lands. As part of this encroachment, all diversion infrastructure will be removed and the stream channel will be altered by hand tools as needed to restore the natural width and grade.

Reasons for Exemption
The project will permit an existing water diversion and remove a second water diversion from unnamed tributaries to the Klamath River. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
