Reasons for Exemption
Staff has evaluated the renovation of the playground at Tierra Rejada Park for compliance with the California Environmental Quality Act. The action is exempt from CEQA as a Class 1 (existing facilities) exemption from CEQA based on State CEQA Guidelines Section 15301. This applies on the basis that the City will continue to operate the property as a park which is consistent with prior uses on the site. In addition, the renovation is exempt from CEQA under the "catch-all exception" because it can be seen with certainty that the renovation will not have the possibility to have a significant effect on the environment. This exception applies because the City is not proposing to use the property or to change the property to a new use at this time.
