Agreement between the Kern County Water Agency (Agency), Dudley Ridge
Water District (Dudley), Metropolitan Water District of Southern California (Metropolitan) and California Department of Water Resources (DWR) for a multi-year exchange of Dudley's State Water Project (SWP) water and Irvine Ranch Water District's (Irvine Ranch) banked non-SWP
water.
Dudley and Irvine Ranch entered into a multi-year exchange for up to
40,000 af of water. Dudley will transfer up to 40,000 af of its SWP water to Metropolitan on behalf of Irvine Ranch. In exchange, Irvine Ranch will deliver up to 40,000 af of water to Dudley by one of three means: recovery of banked non-SWP water from their Banking Projects to Dudley landowners within Kern County, exchange oflrvine Ranch's banked non-SWP water for the Agency's SWP water for delivery to Dudley or by recovery oflrvine Ranch's non-SWP water for pump-in to the California Aqueduct for delivery to Metropolitan, in which DWR will deliver Metropolitan's SWP water to Dudley by exchange.

Provides that a lead agency mat determine an activity to be exempt from CEQA in that it utilizes on existing facilities. This transfer involves delivery of water entirely within the Agency's service area, and exclusively utilizes existing facilities

Reasons for Exemption
Provides that a lead agency may determine an activity to be exempt based on a general rule that CEQA applies only to projects that have potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The Agency finds that approval of the proposed water transfer has no possibility of significant effect on the environment for the following reasons:
1. The proposed action consists of a one-time water transfer that will use existing facilities and would not require any construction or grading.
2. The proposed action does not constitute a new permanent source of water supply and will not result in any growth inducing or cumulative environmental impacts.
3. There will be no change in land use.
