The Project consists of a request for a Minor Conditional Use Permit and Letter of Public Convenience or Necessity in order for the Bank Shot to obtain a Type 40 (On-Sale Beer) alcohol license from the California Department of Alcoholic Beverage Control (ABC). Elk Grove Municipal Code (EGMC) Section 23.86.030 requires approval of a MUP for the accessory sale of beer for on-site consumption where the primary use is an indoor amusement/entertainment facility.

The California Environmental Quality Act (Section 21000, et seq., of the California Public Resources Code - hereafter CEQA) requires analysis of agency approvals of discretionary "projects." A "project," under CEQA, is defined as "the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment." The proposed Project is a "project" under CEQA.
