Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2018-0491-R1, pursuant to Section 1602 of the Fish and Game Code to Tobias Hafenecker-Dodge. The project is limited to one encroachment. One encroachment is for interim winterization of the project area including an onstream pond. Work for this encroachment will include removal of pond spillway rock armor, excavation and relocation of fill material, recontouring of the pond fill face, compaction and rock armoring as necessary to minimize erosion, and implementation of additional erosion control measures onsite (property). This Agreement serves as an interim measure to minimize impacts to fish and wildlife resources through the winter rain period and does not represent the final Agreement for projects notified for under LSA Notification No. 1600-2018- 0491-R1. Additional actions shall be taken through the Lake or Streambed Alteration Program process to cure violations of Fish and Game Code documented on parcel.

Reasons for Exemption
One encroachment is to winterize the project area to minimize sediment discharge to waters of the state including, but not limited to alteration of an unpermitted onstream pond spillway. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
