The project is located within a levee haul road located within the active mine site. The levee haul road separates the active channel of the Bear River from a 75-acre mine pond located 75 feet to the west of the river channel at its closest location.

Reasons for Exemption
The project is exempt from the requirements of CEQA because construction of the sheet pile wall extension is necessary to prevent an emergency. The geologic unit that comprises the area that separates the mine pond from the active river channel consists of unconsolidated sands and gravels. Significant rain season erosion of the geologic unit (e.g. where the levee haul road is located) has occurred over the last several rain seasons, threatening to breach the levee during high river flow events. Breach would result in pit capture of the river and downstream flooding resulting from the discharge of the mine pond, a 75-acre lake, to the river.
