Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2019-0334-R1 , pursuant to Section 1602 of the Fish and Game Code to Mr. Joshua Nicely. The project is limited to 6 encroachments on an Unnamed Tributary to the Trinity River. Five encroachments are to upgrade and maintain or decommission culverts and ponds. Work for these encroachments will include some or all of the following: diversion of water around project site, excavation, culvert removal and replacement, backfilling and compaction of fill, channel reconstruction and rock armoring as necessary to minimize erosion. One encroachment is for an existing but unpermitted water diversion for domestic use and irrigation. Work for the water diversion will include modification use and maintenance of the water diversion infrastructure.

The project to be completed is located within Trinity River watershed, approximately 1.55 miles southeast of the town of Hawkins Bar, County of Trinity, State of California. Reasons for Exemption
The project will permit remediation of an existing water diversion stream crossings and ponds associated with cannabis cultivation activities. Work was conducted without a Streambed Alteration Agreement (Fish & Game Code [FGC] Section 1602) on or before September 5, 2018. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probable future projects.
