Document Description
The Agency is a State Water Project ("SWP") Contractor . with long-term lease rights to a non-SWP water supply (referred to as the "Nickel Water") that originates in Kern County and is leased and delivered to the Agency by AVEK. The project includes a Memorandum of Understanding ("MOU") between the Agency and LADWP by which the Agency agrees to a one-time transfer of 100 acre-feet of the Nickel Water to LADWP. LADWP has already completed construction of a connection from its LA Aqueduct to the ! SWP at the California Aqueduct ("LADWP Connection"); under the MOU, 100 acre-feet of the Nickel Water would be transferred to the LADWP Connection on an agreed upon schedule in 2019. The project additionally includes an agreement ("Agreement") that allows the Agency to put the I 00 acre-feet of Nickel Water in the California Aqueduct at the Tupman turnout so that it may be delivered to the LADWP Connection. On August 5, 2019, the Agency's Board of Directors authorized the Agency's General Manager to finalize and sign the MOU and to undertake all steps necessary to implement the 100 acre-foot transfer with LAD WP (collectively, the "Project").

Reasons for Exemption
A VEK and DWP have already filed Notices of Exemption for the transfer of 100 acre-feet of the Nickel Water to LADWP, with each finding that the transfer is categorically exempt from CEQA under State CEQA Guidelines section I 530 I. (See SCH No. 2019048435 .) The Agency likewise finds the Project exempt from CEQA under State CEQA Guidelines section 15301 because implementation of the Project would consist of the operation of existing public infrastructure. The Project would not result in any new construction or other activity that could adversely impact the environment. Furthermore, the Project is additionally exempt under State CEQA Guidelines section 15061 (b )(3), which exempts those activities for which it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Here, the Project is exempt from CEQA as there is no possibility that it will have any significant effect on the environment; in particular, the Project merely involves the transfer of I 00 acre-feet of water (to which the Agency already has long term lease rights) through existing infrastructure designed: to facilitate such transfer.
