Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2018-0797-R1 pursuant to Section 1602 of the Fish and Game Code to Three Creek Partners, LLC represented by Jens Sund. The project is limited to new culvert construction on McDonald Creek to develop primary residential access off McDonald Creek Road. The crossing is sized to accommodate the modeled 100-year storm event and will consist of an 84-inch x 40-foot long corrugated metal pipe with 1-ton rip-rap placed around the inlet and outlet as erosion protection and energy dissipation. A new domestic diversion with a riparian basis of claim will be developed from an existing spring that emerges on the parcel and forms an approximate 10- by 15-foot pool (impoundment) and has been maintained in the past to be 3- to 4-feet deep. The spring forms a Class II watercourse and flows through an associated wet meadow. The permitted diversion from the spring will consist of a one-inch polyethylene pipe, screened at the inlet, and will gravity feed to a tank containing a float valve.

Categorical Exemption. Type- Class 3; California Code of Regulations, title 14, section 15303. Consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. Reasons why project is exempt: The project is limited to the construction of one new small stream crossing on an intermittent stream and one new diversion from a perennial spring-fed source serving one parcel. There will be no significant adverse impacts on endangered, rare, or threatened species or their habitat pursuant to California Code of Regulations, title 14, section 15065.
