Reasons for Exemption
The State CEQA Guidelines provide a series of Statutory Exemptions for actions that have been deemed by the State Legislature to be exempt (not subject to) from the California Environmental Quality Act (Cf.QA). The proposed emergency replacement of an existing manhole on the City of Chino sewer main and installation of a new connection to the SARI line has been determined to qualify for a Statutory Exemption under the State CEQA Guidelines, section 15269(b). Statutory Exemption 152369(b) exempts"(b)Emergency repairs to publicly or privately-owned service facilities necessary to maintain service essential to the, public health, safety or welfare. Emergency repairs include those that require a reasonable amount of planning to address an anticipated emergency.The proposed manhole replacement and connection to the SARI line has been determined to not fall under the jurisdiction of CEQA and the State CEQA Guidelines because these activities fall within the scope of the criteria listed in Section 15269(b). Therefore, this action qualifies with the requirements for a Statutory Exemption In compliance with Section 15269(b) of the State CEQA Guidelines.
