Reasons for Exemption
The adoption of Ordinance No. 2019-6-2 is statutorily exempt from CEQA review and under Public Resources Code section § 21065 and State CEQA Guidelines § 15378(a) because it is not a "project" as defined therein. Section 21065 provides, in pertinent part, that a project is "an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect change in the environment.'' Because adoption of Ordinance No. 2019-6-2 will cause neither a direct, nor a reasonably foreseeable indirect change in the environment, it is not a project under CEQA and is therefore exempt pursuant to Public Resources Code § 21065 and State CEQA Guidelines§ 15378(a).
