Reasons for Exemption
General Exemption (Sec. 15061(b)(3)) Sewer System Management Plans (SSMP) are primarily plans for the operations and maintenance of existing sewer systems. While the SSMPs may articulate the need for replacement or construction of new facilities , the plans do not constitute design approval for such facilities. Each campus will propose specific capital projects necessary to implement its SSMP that will include evaluation pursuant to CEQA at the time of design approval. Therefore, approval of the updated SSMPs is exempt from CEQA under the "common sense" exemption, CEQA Guidelines Section 15061(b)(3), which applies when it can be seen with certainty that there is no possibility that the project may have a significant effect on the environment. On a separate and independent basis, management activities under the plans are categorically exempt under CEQA Guidelines Section 15301, Existing Facilities, which allows for the operation and maintenance of existing public facilities with negligible or no expansion of use.
