Reasons for Exemption
CEQA requires analysis of agency approvals of discretionary projects. A project, under CEQA, is defined as "the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment" (CEQA Guidelines Section 15378). The proposed project is a project under CEQA. Staff has determined that the project is exempt from CEQA Guidelines section 15303 (New Construction or Conversion of Small Structures). CEQA Guidelines section 15303 applies to projects that consists of new construction and location of limited numbers of new, small facilities or structures including, but not limited to accessory (appurtenant) structures including garages, carports, patios, swimming pools, and fences. The proposed fence plan provides the design elements required to establish an attractive neighborhood and will be compatible with other buildings on adjoining and nearby properties with similar fence designs. The fence will add aesthetic value to the residence and complement the Old Town Historic value. No special circumstances exist that would create a reasonable possibility that granting a design review would create a significant adverse effect on the environment.
