Document Description
CDFW has executed Lake and Streambed Alteration Agreement No. 1600-2018-0045-R1, pursuant to section 1602 of the Fish and Game Code to Tyler Thompson. The project is limited to two encroachments. One encroachment is for water diversion from an unnamed tributary to the Trinity River. Work for the water diversion will include use and maintenance of the water diversion infrastructure, and seasonal restrictions on allowable amounts of water diversion. The second encroachment is for an existing on-stream reservoir located within an unnamed tributary to the Trinity River. The existing on-stream reservoir is approx 20' wide x 20' long x 2' deep is located within an intermittent stream. The reservoir has been in place for decades and has become a functioning part of the stream. No work is proposed for this site at this time. Permittee agrees to monitor the reservoir for signs of failure and potential for delivery of sediment downstream. The Permittee has disclosed two water wells used for irrigation located on the parcel and agrees to provide monthly water extraction amounts in annual reports to CDFW. Well locations (Lat/Long): Well A: 40.8199, -124.4942; Well B: 40.8192, -123.4942.

Reasons for Exemption
The project retroactively permits a domestic surface water diversion with seasonal restriction on allowable amounts of water, and an existing, small on-stream reservoir that has become a functioning part of the stream. There would be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project would not constitute an expansion of use.
