Document Description
The Town of Mammoth Lakes Cannabis Regulations Update (zoning code amendment 18-002) included the following components: 1) amended Town municipal code table 17.24.020 to remove the restriction that cannabis retailer businesses not be located on the ground floor of buildings along Primary and Secondary Active Frontages; and 2) amended Town municipal code section 17.52.085.D to remove the restriction that cannabis goods not be visible from outside the premises and clarify that cannabis retailers located on the ground floor along active frontages are not permitted to have opaque windows. The town council adopted the ordinance making the amendments on November 19, 2018.

The project is exempt b/c the following criteria are met: The adoption of the Town of Mammoth Lakes Cannabis Regulations Update and the subsequent amendments to the municipal code related to cannabis qualify for this exemption since: 1) the Town's cannabis regulations continue to require approval of a discretionary use permit for all commercial cannabis activities; 2) the approval of the subsequent discretionary use permits are subject to environmental review pursuant to division 13 (commencing with section 21000) of the PRC; and 3) the update to the town's cannabis regulations was adopted prior to July 1, 2019.
