Reasons for Exemption
CEQA requires analysis of agency approvals of discretionary "projects." A "project," under CEQA, is defined as "the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment" (State CEQA Guidelines Section 15378). The proposed project is a project under CEQA. The project is exempt from CEQA pursuant to State CEQA Guideline Section 15301 (existing facilities). Section 15301 applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures facilities, mechanical equipment, or topographical features, involving negligible or no expansion or use beyond that existing at the time of the lead agencies determination. The project proposed to hold up to 14 events with outdoor amplified music in the covered patio area at an existing restaurant. No exterior or on-site improvements are included with the project. The project has been conditioned to maintain noise levels at the event venue source and at property lines as well as to prohibit events past 10 pm in order to ensure compliance with the General Plan Noise Element and EGMC standards contained in Chapter 6.32 (noise control).
