Document Description
On July 26, 2018, San Diego County Water Authority authorized its general manager to enter into an agreement with the Sycuan Band of the Kumeyaay Nation, et al to extend water service to the Sycuan Reservation compliant with CWC 71611.5 and containing terms and conditions of the service, including collection of the net present value of the ad valorem taxes, and other processing fees and charges. In addition, adequately sized public water infrastructure is in place to serve the lands.

Reasons for Exemption
The public water infrastructure is in place to serve the lands subject to the agreement, and this action does not require a change in Water Authority's operations. The Water Authority determined that the subject lands met the criteria for water service established by CWC 71611.5b, and compliant with CWC 71611.5a, the water authority applied its terms and conditions substantially the same as if the lands had been fully annexed into the water authority. Therefore, the action does not meet the definition of a discretionary project defined in CEQA guidelines 15357.
