Document Description
Pursuant to PRC Section 25402.1(h)(2) and section 10-106 of title 24 of CA Code of Reg, Alameda County has applied to the CA Energy Commission for a determination that its locally adopted energy efficiency standard, enacted in local ordinance 3425, will require buildings to be designed to consume no more energy than permitted by the building energy efficiency standards adopted by the energy commission. The Energy Commission's building standards are set forth in title 24, part 6 of the code of regulations. The ordinance reduces the max outdoor lighting power allowances, from the max allowed wattages in the 2016 energy standards for non residential building occupancies, by 32-81%, depending on application, Consistent with PRC Section 25402.1(h)(2), the Energy Commission found that the Alameda County's ordinance will require the diminution of energy consumption levels permitted by the 2016 energy standards.

Reasons for Exemption
The finding by the Energy Commission required by PRC Section 25402.1(h)(2), that Alameda County ordinance will require the diminution of energy consumption levels permitted by the 2016 Energy Standards, involves the comparison of the energy savings of the ordinance pursuant to an objective fixed standards, and does not require the exercise of judgement or deliberation on the part of the Energy Commission. It is therefore a ministerial act consistent with section 15369 of title 14 of CA Code of regulations. The Energy Commission also determined that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment.
