Sanitation Districts filed a wastewater change petition to reduce flow to San Jose Creek and change the place of use and purpose of use of the treated wastewater. Sanitation Districts is the CEQA lead agency for the project and certified a Final EIR and issued a Notice of Determination (NOD) in November 2019 (State Clearinghouse No. 2018071021 ). Pursuant to California Code of Regulations, title 14, section 15096, subdivision (f), the State Water Board has considered the environmental effects.
