- CARB staff is proposing to amend the Cap-and-Trade Regulation. The Cap-and-Trade Regulation amendments proposed include measures to respond to the direction of Assembly Bill (AB) 398 (Ch. 135, Statutes of 2017). AB 398 provides direction on a post-2020 Cap-and-Trade Program, including changes to the offset usage limit, direction on allowance allocation, and establishing two price containment points and a price ceiling. In response to this and to Board Resolution 17-21, CARB is initiating a new rulemaking to design a post-2020 Cap-and-Trade Program that conforms to AB 398 requirements. Additional amendments to clarify and improve the Regulation also may be proposed.
