Project is exempt because the activities carried out by North Kern Water Storage District pursuant to the Settlement Agreement will continue the current use of existing facilities in order to maintain the historic diversion, conveyance and use of Kern River water for existing and long-established beneficial uses; this project concerns an existing and ongoing project which was first approved by North Kern, and its predecessors, many decades prior to the enactment of CEQA; and North Kern does not propose to modify its existing facilities and activities in a way that might cause a new significant effect on the environment. For these reasons, it can be seen with certainty that there is no possibility that the project may have a significant effect on the environment.
