Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2017-0385-R1, pursuant to Section 1602 of the Fish and Game Code to Mr. Steve Stroud The project is limited to two encroachments (40.7447, -123.9492). One encroachment is for water diversion from an Unnamed Tributary to Black Creek. Work for the water diversion includes modification, use, and maintenance of water diversion infrastructure. The other encroachment will remediate the head of a Class II spring/wetland that was modified without permits. Modification of the spring included excavation, lining of a 700,000 gallon pond, and installation of a drain pipe under the pond to drain the spring to the existing channel. The pond liner shall be removed, the drain pipe shall be removed, and the pond area shall be graded and planted per the approved Grading, Stream remediation, and the Revegetation Plans.

Reasons for Exemption
The project will remediate the head of a Class II stream by removing a lined pond and drain pipe, re-contouring, and planting with appropiate native vegetation. There will be no significant adverse impact on endangered, rare or threatened species or their habitat pursuant to section 15065. There are no hazardous materials at or around the project site that may be disturbed or removed. The project will not result in impacts that are significant when viewed in connection with the effects of past projects, the effects of other current projects, and the effects of probably future projects.
