Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement number 1600-2017-0342-R1, pursuant to Section 1602 of the Fish and Game Code to Mr. Jack Noble The project is limited to one encroachment to remove approximately 975 cubic yards of concrete and other debris placed on and in the bed, bank, and channel of the Van Duzen River in violation of Fish and Game Code section 1602 ad 5652(a). The area covered by this Agreement is shown on the attached map (Figure 1). All concrete and other debris in the area identified as part of the violation will be removed using a hydraulic excavator with a thumb operated from the top of bank. All removed debris will be moved outside the riparian zone and disposed of according to State and local laws and ordinances, or stored in a stable upland area at least 150 feet away from the high water mark of Waters of the State.

Reasons for Exemption
The project is limited to one encroachment to remove approx. 975 cubic yards of concrete and other debris placed on and inn the bed, bank, and channel of the Van Duzen River that was the subject of CDFW's May 25, 2017, Notice of Violation. The project will be conducted outside of rainy season, when impacts to sensitive aquatic species will be minimized. There would be no significant adverse impact on endangered, rare, or threatened species, or their habitat pursuant to California Code of Regulation, title 14, section 15065
