Document Description
The 2017 Water Exchange Agreement ("Agreement") allows for the exchange of 2,000 acre-feet of State Water Project ("SWP") water from CLAWA to SGPWA in Calendar Year 2017, and with SGPWA returning 1,000 acre-feet of water to CLAWA no later than the end of Calendar Year 2027. SGPWA approved the Agreement on June 19, 2017.

Reasons for Exemption
The water exchange authorized by the execution of this Agreement is exempt from CEQA pursuant to State CEQA Guidelines section 15301 because it will involve no change in the type of use or expansion of use CLAWA and SGPWA's existing facilities. Rather, the water exchange will involve the exercise of CLAWA and SGPWA's existing right to SWP water, and the transfer of said water between CLAWA and SGPWA pursuant to the terms of the Agreement. As a result, the exchange will consist merely of the continued operation of CLAWA and SGPWA's existing facilities and the use of those facilities to temporarily transport water to a different location. In addition, the water exchange is exempt from CEQA pursuant to State CEQA Guidelines section 15304 because the exchange will only involve a minor, temporary alteration of the condition of water, and will not require the removal of any healthy, mature, scenic trees. Furthermore, the water exchange is also exempt from CEQA pursuant to State CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that there is no possibility that the exchange may have a significant impact on the environment. Implementation of the Agreement will only involve an exchange of water between agencies. No physical facilities will be constructed to produce or transport water because all such required facilities already exist. In addition, no new water production or transportation capacity is created by the Agreement. As a result, it can be seen with certainty that there is no possibility that the exchange may have a significant impact on the environment.
