Reasons for Exemption
The Governor's March 7, 2017, Emergency Declaration allows the utilization of certain CEQA exemptions. Since the pond is necessary to mitigate the impacts resulting from an emergency, construction of the emergency pond is exempt from CEQA pursuant to section 21080(b)(3) and (4) of the Public Resources Code and 14 CCR 15269 of the CEQA Guidelines.
