Document Description
Under section 404 of the federal CWA, an activity involving discharge of dredged or fill into a jurisdictional water body must obtain a federal section 404 permit and a section 401 State Water Quality Certification to ensure that the activity will not violate established state water quality standards. The US Army Corps of Engineers is the federal regulatory agency responsible for implementing section 404 of the CWA. The CA SWRCB in conjunction with the nine RWQCBs are delegated the responsibility to administer the 401 water quality certification program in CA. The SWRCB is the lead for the RGP 401 certificate and is a responsible agency under CEQA.
